Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the HomeLUQ mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Luqtech LLC ("Company," "we," "us," or "our"). If you violate any of these Terms, we reserve the right to suspend or terminate your access without notice.

2. Definitions

• "Service" means the HomeLUQ mobile application and all related features, content, and functionality.
• "User Content" means any photos, images, or other materials you upload to the Service.
• "AI-Generated Content" means design images, suggestions, and visualizations created by our artificial intelligence based on your User Content.

3. Description of Service

HomeLUQ is an AI-powered interior design application that:

• Analyzes room photographs you upload
• Generates personalized design style suggestions
• Creates AI-generated visualizations showing your room with new decor and styling
• Preserves your room's original structure while transforming the design

4. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

This license does not include the right to:

• Modify, copy, or create derivative works of the App
• Reverse engineer, decompile, or disassemble any part of the App
• Remove or alter any proprietary notices, trademarks, or watermarks
• Sublicense, sell, rent, or lease the App to third parties

5. User Content

5.1 Your Ownership

You retain ownership of all photos and images you upload. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to process, store, and display your images solely to provide the Service.

5.2 Your Responsibilities

You agree not to upload content that:

• You do not have the right to share
• Infringes on third-party intellectual property rights
• Contains illegal, harmful, or offensive material
• Violates any applicable laws

5.3 Storage and Retention

Your images are stored on our servers subject to the following retention policies:

• Photos and Designs (Free Users): Projects and associated images are retained for 7 days, after which they may be automatically deleted.
• Photos and Designs (Paid Subscribers): Projects and associated images are retained as long as the project is active and your subscription remains valid.
• Account Data: Retained as long as your account is active.
• Usage Logs: Retained 30 days for operational purposes.

You are responsible for saving any content you wish to keep permanently. We do not guarantee preservation of your content and recommend maintaining your own backups.

5.4 Content Removal

We may remove any content that violates these Terms without prior notice.

6. AI-Generated Content

6.1 Nature of AI Output

Our AI-powered features generate design suggestions and visualizations based on your uploaded photos. You acknowledge that:

• AI-generated designs are for inspiration only
• Results may not be architecturally or structurally accurate
• Color, material, and texture representations may vary from reality
• Design quality depends on input image quality and other factors
• We rely on third-party AI services that may produce varying results

6.2 No Professional Advice

AI-generated content does not constitute professional interior design, architectural, or construction advice. We accept no liability for any loss or damage resulting from reliance on AI-generated designs.

6.3 Watermarks

All AI-generated images include watermarks. You agree not to remove, alter, or obscure these watermarks.

7. Prohibited Conduct

You agree not to:

• Use the Service for illegal purposes
• Attempt unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated tools, bots, or scrapers
• Circumvent security measures
• Create multiple accounts to abuse features
• Manipulate device identifiers
• Commercially redistribute AI-generated designs without permission

8. Intellectual Property

8.1 Our Rights

The App, including its design, code, features, and branding, is owned by Luqtech LLC and protected by intellectual property laws. Unauthorized reproduction or distribution is prohibited.

8.2 Trademarks

"HomeLUQ" and associated logos are trademarks of Luqtech LLC. Use of our trademarks requires prior written consent.

8.3 Your Feedback

Any feedback, suggestions, or ideas you provide become our property and may be used without compensation or attribution to you.

9. Third-Party Services

The Service integrates with third-party providers, including but not limited to:

• AI Processing Services - Image analysis and design generation
• Cloud Infrastructure Providers - Data storage and backend services
• Apple - Authentication and payment processing

We are not responsible for third-party services, their accuracy, availability, or compliance. Your use of such services is subject to their respective terms and policies.

We may use any commercially available AI services, including but not limited to services from Google, OpenAI, Anthropic, Stability AI, and others. If you have concerns about specific AI providers processing your images, please do not use the Service.

10. Purchases and Payments

All purchases are processed through Apple's App Store. By making a purchase, you acknowledge immediate access to digital content. Refund requests are handled by Apple according to their policies.

We reserve the right to modify pricing at any time. Price errors may result in order cancellation.

11. Device and Connectivity

11.1 Requirements

The App requires iOS 17.0 or later and an active internet connection. We cannot guarantee compatibility with all devices or operating system versions.

11.2 Data Charges

You are responsible for any mobile data charges, including roaming fees, incurred while using the App.

11.3 Device Security

We recommend against using jailbroken or rooted devices, as this may compromise security and App functionality.

12. App Updates and Modifications

We may release updates that modify or remove features. You agree that:

• Updates become part of the App and are subject to these Terms
• We have no obligation to provide updates or maintain specific features
• Continued use requires accepting available updates

We may modify, suspend, or discontinue the Service at any time without liability.

13. Account Termination

13.1 By You

You may stop using the Service at any time. To delete your account and data, use Settings > Delete Account in the App.

13.2 By Us

We may suspend or terminate your access at any time, with or without cause, for reasons including:

• Violation of these Terms
• Fraudulent or abusive behavior
• Extended inactivity

13.3 Effect of Termination

Upon termination, your license ends immediately and we may delete your data. Sections 6, 8, 14, 15, 16, and 18 survive termination.

14. Disclaimer of Warranties

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted or error-free
• AI-generated designs will meet your expectations or be implementable
• Results will be accurate, reliable, or suitable for any purpose

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Our total liability shall not exceed amounts you paid for the Service in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We are not liable for loss of data, profits, or business opportunities
• We are not liable for property damage or injury from implementing AI-generated designs

16. Indemnification

You agree to indemnify and hold harmless Luqtech LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms or any law
• Any damage resulting from implementing AI-generated designs

17. Copyright Claims

If you believe content on the App infringes your copyright, contact us with:

• Your signature (physical or electronic)
• Identification of the infringed work
• Identification of the infringing material
• Your contact information
• A good faith statement that use is unauthorized
• A statement of accuracy under penalty of perjury

18. Dispute Resolution

18.1 Informal Resolution

Before filing a claim, contact us at support@luqtech.app. We will attempt to resolve disputes within 30 days.

18.2 Governing Law

These Terms are governed by California law. Legal proceedings shall be brought exclusively in California courts.

18.3 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS OR CLASS-WIDE ARBITRATION.

18.4 Time Limitation

Any claim must be filed within one (1) year after it arises or be permanently barred.

19. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated with at least 30 days notice. Continued use after changes constitutes acceptance.

20. General Provisions

Entire Agreement: These Terms and our Privacy Policy constitute the complete agreement between you and us.

Severability: If any provision is unenforceable, remaining provisions continue in effect.

Waiver: Failure to enforce any provision does not waive our right to enforce it later.

Assignment: You may not assign your rights. We may assign ours without restriction.

21. Apple App Store Terms

These Terms are between you and Luqtech LLC, not Apple. Apple has no obligation to provide support or maintenance. Apple is not responsible for:

• Product liability claims
• Regulatory compliance claims
• Consumer protection claims
• Third-party IP infringement claims

Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them.
